STALLION SERVICE CONTRACT

This Service is Subject to the Following:
1. A booking fee of $____________ of the above fee is payable with this contract
and the balance of $___________ plus all
unpaid expenses will be payable upon receipt of an invoice or when the mare
leaves the farm, whichever is first. Booking fee
is not refundable. The Breeder requires 48 hours advance notice when the Mare
Owner wishes to remove his mare(s) from
the farm. This will allow us sufficient time to prepare the final statement so
the Owner may settle his account.
2. The mare will be in healthy and sound breeding condition. If information
regarding worming date is not furnished, your
mare will be wormed upon arrival and every 60 days thereafter. All dry mares
will be cultured and/or biopsied at veterinarian’s
discretion and appropriately treated.
3. Mares that are not halter broken will not be accepted.
4. 18% interest will be charged on all accounts in excess of thirty days. All
mares left more than 30 days, after 45 day check,
without prior agreement will be charged double boarding fees.
5. A photostatic copy of registration papers (both sides), a veterinarian’s
health certificate, including uterine culture, worming,
immunization records, including strangles vaccination & current Coggins test
shall be furnished upon delivery of mare to
breeding farm. If these are not presented upon mare’s arrival, the Breeder shall
have the attending veterinarian make proper test
evaluations at the Mare Owner’s expense.
6. It is my understanding that BSB R11 Quarter Horses will not be responsible for
accident, sickness, or death to my mare
and/or her foal. The owner/management will exercise judgment in the care and
supervision for her and/or her foal. It is also
understood that I likewise will not be responsible for any disease, accident or
injury to the stallion. BSB R11 Quarter Horses,
stallion owners and/or agents will not be liable for any infectious,
transmittable or inheritable diseases or conditions to the foal
resulting from this breeding.
7. The Owners agree to diligently try to settle my mare. If, however, the mare
does not settle, I will hold BSB R11 Quarter
Horses harmless. There is no live foal guarantee for any mare leaving the
breeding farm before checked safe in foal by our
attending veterinarian. Any exception to this will be stated in writing and
signed by owners or managers.
8. It is further agreed that should the above named stallion die or become unfit
for service, or if mare dies or becomes unfit to
breed, then this contract shall become null and void.
9. When the owners or managers sign and return one copy of this contract to me,
it will be a binding contract on both parties,
subject to the terms and conditions of this contract. (Please return the
original to BSB R11 Quarter Horses)
10. ALL EXPENSES MUST BE PAID UPON RECEIPT OF STATEMENT and no mare leaves
without being paid in full.
11. Foaling fee to be charged in the amount of $250.00 if mare foals at BSB R11
Quarter Horses.
12. Because of the security of the stallions, our gates will be locked at 7:00
p.m. each night. If you are to arrive later than 7:00
p.m. or before 7:00 a.m., please make previous arrangements by calling stallion
manager.
13. Stallion service certificates will be issued only after mare owner has
notified stallion manager that the mare has produced
a live foal and all bills on the mare have been paid, except that if the mare
owner transfers ownership of the mare before
foaling, stallion service certificate will be issued upon such transfer when all
conditions of this contract have been met to date.
14. A PHOTOSTATIC COPY, BOTH SIDES THEREOF, OF THE REGISTRATION PAPERS ON YOUR
MARE MUST
ACCOMPANY CONTRACT. OWNER RECORDED ON REGISTRATION CERTIFICATE WILL BE RECORDED
ON THE
STALLION BREEDING REPORT.
15. This contract is not transferable or assignable. This contract contains a
‘live foal guarantee”. A live foal is described as a
newborn which stands and nurses without assistance, period.
16. If your mare and/or foal is insured, fill in the name and telephone number
of your agent.

17. In order for live foal guarantee to remain in force and effect, the mare
must receive Pneumabort-K (Ft. Dodge) or Prodigy
(Bayer) shots in a timely fashion according to recommendations of the mare
owners veterinarian 5, 7, & 9 months gestation.
18. Under the Michigan Equine Activity Liability ACT (1994 RA. 351) an equine
professional is not liable for an injury to or the
death of a participant in a equine activity resulting from an inherent risk of
the equine activity.
